Digital Economy Act 2010 to Face Judicial Review

The provisions of the Digital Economy Act 2010 (the "Act") as they relate to online copyright infringement face an uncertain future in light of the High Court's decision in November to grant permission for a judicial review on the application of two of the UK's largest ISPs, BT and TalkTalk.

Meanwhile, the Parliamentary Culture, Media and Sport Committee, which announced an inquiry in November into the implementation, practicality and likely effectiveness of the Act, has been forced to postpone its inquiry pending the outcome of the judicial review proceedings.
